Even so, under current Texas state law, it is illegal to use a drone to capture an image of private property without the owner's consent. Yet, there are many exceptions. It is legal if you are a law enforcement office, a professor doing research, a surveyor, an employee of an oil, gas or power company or more than a dozen other exceptions.

Using a drone to spy on neighbors or property is expressly prohibited in Texas. To quote the law:

A person commits an offense if the person uses an unmanned aircraft to capture an image of an individual or privately owned real property in this state with the intent to conduct surveillance on the individual or property captured in the image.
(b) An offense under this section is a Class C misdemeanor.
(c) It is a defense to prosecution under this section that the person destroyed the image:
(1) as soon as the person had knowledge that the image was captured in violation of this section; and
(2) without disclosing, displaying, or distributing the image to a third party.

How about some advice sstterry, what would be the thoughts on shooting a drone that someone was flying over your private property? Let's include it being posted as private property, no trespassing.
Kenny, if someone is tresspassing on your property you can NOT shoot them. It is not up to you to enforce the law. You contact LE and report it. You can not shoot someone's animal that is on your land. You call LE and they get it off, or call animal control etc. Another's personal property.. a motorcycle or ATV or jeep that someone was riding on your land, and you catch them, or it tears up or something, and they leave it...you can not destroy it, or confiscate it. You call LE and file tresspassing charges. IN the case like SIlver posted about, that IS a misdemeanor, you can not shoot it or destroy it. You report it and LE will file the charges. ( if you do not delete any photo or videos you may have recorded). You shoot it, and you will be charged with criminal destruction of property. There is a website you can go to, and it is connected to a satellite that can zone in on anyplace you have the address too ,and get a close up view detailed enough to see if the roof had shingles that need replacing.

That is correct. They have to be notified and trespassssed. Then if they come back they can be arrested.

Unless they are purposely doing damage.
