I'm not real clear on this...can the USDA totally prevent you from doing what you want to your land, or can they only punish you by not allowing you to receive USDA programs if you choose to ignore them?

Yes. As can the EPA as well as local gov't agencies in your area. In some cases environmental groups can get in an uproar and prevent you from doing what you want to on your own land, they get the Gov't involved to stop you.

Just got off the phone with my USDA district rep. Speaking in reference to clearing properties, (have about 25 acres of timber to clear) he said that clearing land that is deemed ineligible for clearing by USDA will disqualify you from all program eligibility for ALL your properties. Also added, just because USDA qualifies it as eligible ( i.e. not a wetland or highly erodible soil) does not mean the EPA or other govt agencies will also agree with that determination.. so in a nasty nutshell, you need to have a big azz alphabet soup party out at the property before you go to clear anything...whole thing makes me ill.

Before everything got to technical one of the benefits of ownership was the ability to use it and do with it as you pleased. Now days it takes an act of congress to do anything. Sometimes it's better to just do it....now if someone drives up when you're half through and tells you to stop and they have that authority well you'll have to stop. In the meantime I'd make sure my fences were tight, my gates locked and go on about my business. Let the neighbors worry about their own places.

If you have farmable land you have to have a Farm Number with the FSA office if your report your planting dates and crops. I also get a card from the tax collectors office asking if any changes have been made to the wetlands on my property for homestead exemption. about 10yrs I was going to enroll in crp program and the land had to show conventional row crops for 3 yrs to be eligible. when I looked at the maps of the tillable land that was the area I wanted planted didn't qualify for it. Their are ways to get around it if you have 5 acres of low land and want to use it you can create 5 more acres nearby and it will comply if I understand it correctly. Subtle changes will never be noticed much if the buffer is improved first. What gets nosy neighbors upset is the drastic change. I had a neighbor last year that threated me because I modified the drainage of a field because of flood waters. He said he was going to report me because I was contributing to his neighbor a mile away being flooded. I politely explained that after the "Authorities" came to my place I would gladly take them around to his two pond he dug without permits and how he changed the flood plain. I will spare you the details of what else I told him .

No TB, I wasn't referring to your post..you posted in between.. I meant that my USDA rep referenced EPA and ACE.

Really, the rep made it sound like they were separate...? Idk for sure. As in what ever the usda ruling was may not hold water with EPA or ace. He recommended getting them out there too before clearing any more ground
