what to do

I spent about $8000 on Cheyenne bermuda grass seed this year. I got nothign of a stand. I know that it has been dry but is there any way to get a rep to come out and look at the lack of any results and replace the seed. I read on here a while back that someone planted a seed and with little results and they got the seed replaced. any of you ever heard of this or is it your own risk

plbcattle, I think Mr. Billy is the man that did the very thing that you are speaking of. I am afraid to plant bermuda seed myself. Surely with having spent that kind of money, the seed company would pay attention to your problem. A lot of times I guess it is who you get in touch with. Some people want to make sure their product gets a good name, then some are born to be jerks. Good luck with it all. Let us know how it comes out.
Maybe Mr. Billy can give you a name of someone who was reasonable to work with. Seems I am always throwing Mr. Billy in the fire. But he has a lot of knowledge about these things.

I am trying to get 2 (10 )acre pastures of Cheyenne bermudagrass going. We haven't seen rain in about 6 weeks. I was going to seed the pastures and fill up my 250 gallon sprayer and go over them 4 or 5 times each with water. I was wondering if this will help them get established or am I just wasting my time. I feel that just this little amount of water might help them get off and going.

It is so dry here I am not getting any grass growth. I have had less than 2 inches of rein all summer at the farm. this would be the summer I planted about 25 acres of cheyenne bermuda grass. I have very little grass growth and have had to resort to feeding some hay.

so you planted sometime between May & now, in the middle of a hot, dry summer & expected to get a stand? & want the seed company to compensate you? :?

I can tell you that you wont see any compensation from the seed company. Had it been a bad batch of seed that for some reason did'nt pass the germ test,and got slipped in, you might have half a leg to stand on.With slim to no rain, you're on your own.Welcome to the world of farming. I'd have to agree price for Cheyenne from Seedland last year was $175 per 25# bag or $7 per lb.
@15 lb.s per acre thats $105 an acre
$2625 for 25 acres.
But then I don't travel in the circles that plb does either.
The last bull I bought was a reg. yearling angus fer $650
And even then I tried to get them to throw in delivery ;-)

plb what does your seed rep say? For 8k somebody would be talking to me.

i seeded the end of march. I put 30 lbs to the acre. with labor,fuel,cart and fertilizer it came to right at $8000.
I am not asking for my money back, I was just wondering if they do anything about the seed not coming up. It was a risk I took and some people want satisfied customers. I was just curious

Hello, txag. I didn't know you were a lawyer. Maybe you can help me out, too. I put out a lot of fertilizer in the Spring. Didn't ever get enough rain on it to make any decent hay. Since I could still see it laying on the ground way up in the summer, I told my fertilizer dealer to come and get it. He never showed. I guess that was because I had already paid him for it. Don't you think he should reimburse me for it?

What should I do, Counselor? Thank you.

One draw back with txag is she gets a little squimish when I argue with some one. I am not sure she has the fortitude to make a good class action lawyer. How about frankie?

Ollie and Texan, I know I an somewhat out of your general location but, I have a similar problem. Not only with the fertilizer but, with my oats. You see, I planted some late oats to use for fall pasture. It laid in the ground for 3 weeks and never germinated. It laid right there with the fertilizer. Finally after some rain last week...it came up, but my cattle are gonna starve this winter because it will get frosted next week and stop growing at 3 inches tall.
Txag, what do you suggest? Should I wait till the cattle all die off then file a claim? Or wait till they are almost past help then ask the forum for advise?

Frankie would be good. I think I'll stick with txag, though. I haven't looked up fortitude in the dictionary yet, but I bet she's got it. Fortitude is like some kind of attitude, right? I'm sure she's got it. But you go ahead and hire Frankie. We sure don't want the other side to get her first.

Certherfbeef I am not in your general location but I have decided I may be too close to Texan. The Bible says it rains on the just and the unjust. I have no idea why it won't rain on Texan ,and by association , me.

I saw a petition in the feed store to ask The Texas FEMA director to make Texan to move. They said it was cheaper than moving all us displaced ranchers and farmers.

well, i already told TXCOWBOY that i'm not a lawyer, but here's what i think might be the best approach.......first determine what fertilizer you each put out. if you can find a common link (same distributor, same formulation, etc) maybe you could join up for a class-action suit? then you'll have to determine who to bring suit against. everyone you can think of that was somehow involved in every aspect all the way from the fertilizer production to the application. personally, i'd even throw mother nature in there ;-). then decide how much to sue for. don't forget when determining the amount to be sure to throw in your pain & suffering, your cattle's pain & suffering, your mental anguish, and the biggest one: your spouses' mental anguish for having to put up with you. ;-)

since i'm not a lawyer, i'm not sure if i can charge legal fees, but maybe "consulting" fees? :D
