Pipeline replacement

I have a couple of lines that will be dug up and replaced in their easement. Is their a going price for the damages and rent they will pay per foot. Have about 1/2 miles that will be changed out.
 
Depends on what they are going through?
The last one I had anything to do with went through a standing cornfield in July. We green chopped the corn and they paid an estimated value of the corn.

Mine is just a cattle pasture, but it does cause problems for them to be going through
 
The gas company replaced about a mile of pipeline across us several years back. They didn't pay us anything since they had an easement. They have came back and fixed some washout, a creek crossing, and made an attempt to plant some grass. It was a long drawn out process but we stayed out of each other's way.
 
Rent is probably zero. Why do they need to rent their easement? Damages are all negotiable. I would ask for some kind of work they can do with the machines that have out on your place where they don't have to pay you but you get some work done at a big discount. . Ask them to reshape some problem land and plant some grass along with replanting the easement.
 
You should receive cash for damages. Them having access via an easement or ROW does not grant them the ability to do damage with out liability.

Some times they will come and ask for a construction easement. It's generally wider than your day to day easement as it is very hard to operate with in the normal easement. That is a completely seperate deal and you can negotiate what ever you would like.

My advice is always to list the penalties in the lease for getting outside the easement and define it with a dollar amount. Rules with out penalties are pointless.

There should be a surface damages provision in the lease for any time they need to dig up the pipeline after it has been installed. Some older easements may not have this provision, but I would push for compensation anyway.
 
All depends on the wording in the paperwork.

I have 1/2 mile of natural gas line running thru one of my farms. It was taken by eminent domain year ago, and the original paper work specifically states they are not liable for any surface damages, damages to vegetation, crops, trees, etc.

But the twice it's been dug up in my time they have been good to work with and try to keep the top soil on top and give me plenty of grass seed when they are done.
