In need of advice

I sold a calf to a woman last August, we both agreed the calf should stay on the momma til October, and at that point the momma would be taken to market, and the calf would go to its new home. In the mean time, this woman went in for gallbladder surgery and has been in and out of the hospital since then -- she contacted me once in early November to say thanks for keeping the calf, and ask that I keep it til around Thanksgiving so she can be strong enough to come get it. I, being the sap I am, said "sure, no problem". Well thats the last I have heard from her, and that calf is still in my pasture eating to its hearts content, and breaking fences. Through the town grapevine, I have found out she has been quite ill with pancreas issues, and unable to work, or tend to her home or kids. Their phone has been disconnected, so obviously they aren't doing well and are in need of money. My question is, since I am sending a black heifer to market, should I send this one too and send her money back to her? or do I keep it, and hope she shows up?
 
I agree with rbell assuming she paid for the calf. If not then sell it and send her a note that you could no longer keep the calf and had to ship it. Tell her when she is ready again to come see you. That way there should be no hard feelings. I don't keep them over a month longer than promised unless I know exactly the reason for the delay.
 
My advise would be to consult somebody who is up to date on the laws in your area. While I'm not saying to get an attorney, someone you know should be able to help with this at no charge. I guess I'm lucky in that a friend is a lawyer and helps me from time to time. :)
 
I would make it a point to go to her home and talk to her and find out what she wants to do. If she agrees to let you sell it, go ahead and sell it in her name and have the check sent to her. If not then offer to deliver it to her.

Even though as "TurnThatCowLooseMaw" says you aren't obligated to her; it is still the neighborly and proper thing to do.

And if I were kin to this lady I would make it a point to put a boot in your a$$ so deep it would take a "Dental Surgeon" to get it out!
 
sell the calf but contact her first and tell her what you plan to do. thats what id do. ecpecially if they depended on that calf for money or something. just saying a few words. dont have to listen to my opinion.

I'd just go and ask her what she wants you to do. I'd explain that you can't really keep the calf any longer as it's still eating and costing you money and also that it's causing trouble with the fences. If she's not able to take the calf, I'd either offer to refund the money or to sell it for her and have the sale barn send her the money. To me that's the most honest thing to do. If she's truly in bad shape she may not have thought anymore about the calf-that may be the least of her worries right now.

Who do you think you are?I just got done giving a Man down on his luck at least 200 Cedar Trees to cut for fence posts, beacuse he lost his Mom, a Brother, and His Sister just lost a baby. He's down on his luck and needs to make some money, and pay for funerals.You've truly shown your colors, and they aint' White. How would you have the audacity to kick someone already down? I'd do anything in my power to contact this woman, and see what would be an ammicable remedy to help her out. Whether it's selling the Calf,and giving her a percentage of her money back, or making some other fair arrangement.You sure didn'y score any points with any of us with your heartless point of view.
 
IMO...Rustler 9 and la4angus have it right.... best way to approach it........I have never met any one yet who has asked to get sick and down on their luck. Walk a mile in her shoes so to speak... and worse yet, if she is unable to walk...........you get the meaning...........

Or you could be an arse and follow the advise of Loose cow maw, and keep the money, then while yr at it, may as well sue her not only for damages, but the feed, the supervision of the poor calf, as well as the emotional distress the whole issue has caused you, and don't forget to add loss of consortion with your loved one. Last but not least...hire the very best gall derned lawyer money can buy, and add that cost to the previous lawsuit.
