Because the victim had a gun my guess is, a long ways down the road, a plea agreement to a gross misdemeanor will be reached.
 
I will be very surprised to see anything other than a "This was nothing more than a terrible tragedy, and we regret it happened but the officers were following proper protocol" statement come out of this.
Might be wrong, but that does seem to be how these things play out most of the time.
