I know there are several fire fighters on this board and Its apparent that most don't understand the LAWS. I do not agree with them but they are the laws none the less and in Florida they are very specific. I figured it needed its own thread. here is the statute that constitutes the Fines.


(1) If a Florida Forest Service employee determines that a person has violated chapter 589, this chapter, or any rule adopted by the Florida Forest Service to administer provisions of law conferring duties upon the Florida Forest Service, the Florida Forest Service employee may issue a notice of violation indicating the statute or rule violated. This notice will be filed with the Florida Forest Service and a copy forwarded to the appropriate law enforcement entity for further action if necessary.

(2) In addition to any penalties provided by law, any person who causes a wildfire or permits any authorized fire to escape the boundaries of the authorization or to burn past the time of the authorization is liable for the payment of all reasonable costs and expenses incurred in suppressing the fire or $150, whichever is greater. All costs and expenses incurred by the Florida Forest Service shall be payable to the Florida Forest Service. When such costs and expenses are not paid within 30 days after demand, the Florida Forest Service may take proper legal proceedings for the collection of the costs and expenses. Those costs incurred by an agency acting at the direction of the Florida Forest Service are recoverable by that agency.

(3) The department may also impose an administrative fine in the Class I category pursuant to s. 570.971 for each violation of chapter 589 or this chapter or violation of any rule adopted by the Florida Forest Service to administer law conferring duties upon the Florida Forest Service. The fine shall be based upon the degree of damage, the prior violation record of the person, and whether the person knowingly provided false information to obtain an authorization. The fines shall be deposited in the Incidental Trust Fund of the Florida Forest Service.

(4) A person commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, if the person:
(a) Fails to comply with any rule or order adopted by the Florida Forest Service to administer provisions of law conferring duties upon it; or

(b) Knowingly makes any false statement or representation in any application, record, plan, or other document required by this chapter or any rules adopted under this chapter.

(5) It is the intent of the Legislature that a penalty imposed by a court under subsection (4) be of a severity that ensures immediate and continued compliance with this section.

(6) The penalties provided in this section shall extend to both the actual violator and the person or persons, firm, or corporation causing, directing, or permitting the violation.

590.25 Penalty for obstructing the prevention, detection, or suppression of wildfires.—Whoever interferes with, obstructs or commits any act aimed to obstruct the prevention, detection, or suppression of wildfires by the employees of the Florida Forest Service or any other person engaged in the prevention, detection, or suppression of a wildfire, or who damages or destroys any equipment being used for such purpose, commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Watching the news over the weekend they showed the fire in California. Planes bringing in water to dump on it had to cancel their attempts to avoid hitting drones owned by individuals flying around over the fires.

TB ive actually had to put the bumper to cars and push them out of the way to be able to access the fire scene before.

I can believe it. Every emergency needs a couple hundred stupid a$$ spectators with cameras.

They acted irresponsible. But in reality the city government forced their hand on this by mandating the rules for the firefighters to adhere too. I can tell you from experience that there have been instances where we roll up and the home owner wants us to let it burn. we cant do that and have to attempt to put out the fire.

That's the way it is out here. Our fire protection fee is $90 a year, a small price to pay in my opinion. A few years back there was a home that was allowed to burn to the ground because they refused to pay their dues for many years. Why is it fair for people to not pay until they actually need the service? That would be like driving without insurance, then getting in an accident and wanting to pay your insurance to cover the damage after the fact. A fire district can not run without funds! We train, we update equipment, and we go on calls (all volunteer labor). Money has to come from somewhere so the engines have fuel, equipment is kept operational, and the electricity is paid for in the station.
In CA, there are a ton of people that abandoned their cars on the freeway when the fire went over the top. There are a bunch out there complaining about the tow bill, some over $1800, to have their cars towed off the freeway. The highway patrol and Cal Fire ordered the cars towed so they could clear the freeway... the entire situation sounded wrong.

M-5, I am not sure why you started this thread.... is it a spin off from another thread? I have not been able to keep up on this board with our busy show season.... wondering if I missed something.
 
yes its a spinoff of the control burn thread and mainly because people questioned why we charge for fire calls. You would think the sun only shines in some places once a month because they are so out of touch with reality.

It's still no charge where I live and if you turn in a call a couple of different volunteer fire depts. show up. They do appreciate it if you make a donation but there is no mandatory charge. I let a little one get out about 5 years ago and it burned about an acre. They showed up in less than 10 minutes after I called and put it out really quick. Did a great job. They were having a fish fry in a couple of weeks as one of their fundraisers so I bought the fish. Heck if that thing had got off my property it might still be burning.
 
First off im not doubting anything said.
I started off as a volunteer and have all the respect in the world for them, i got lucky got a paid job, I was an engineer on a dowtown engine company averaged 15 runs per shift, never even came close to having to push someone out of the way, not that I ever would use a bumber on an engine if I needed to, there is a no burn policy in the entire county, theres still brush fires occasionally but never a charge for anything. I live out in another county, they have a tax that pays for the things needed, but they still ask for donations, and ive heard all that crap if you dont donate they will let your things burn up, it has never happened here. Im not sure they could being county suplemented, and I know my pride wouldnt let me have any part of that or slow walking someone in need, no matter if there paid up or not.

Bse our area is very rural and the fire is usually down a pig trail with a 1970 trailer house at the end. When people see smoke they go to look and block the road in .
 
I too am a paid firefighter for a small city as well as a volunteer for a county dept. We operate of a tax based revenue in both places. A portion of city tax money is alloted for our budget. In the county we are broken up in fire districts and based on the rating of your dept determines how much you pay in fire tax, which is based on the value of your property.
 
I was volunteer firefighter for 15 years. We had fund raisers to build our first firehouse and buy equipment. It was a community effort. Then came the government folks with you do this and we will give you money. Then they said its mandatory for you to do this and that. Wasn't a volunteer any more I told to stick mandatory where the sun don't shine.
 
I was a volunteer for the indian reservation that just happened to be my next door neighbors. I had an sneaky motive though. By volunteering I had free aein to hunt the reservation that was only available to reservation residence and me as a volunteer. What was really great about that was the indians never worried about season, I did. I didn;t have to fight the morons hunting public land so it was a win win as far as I was concerned.
 
A question for you volunteer firefighters here in Texas. Is it true that you don't have to pay county taxes and school taxes if your a volunteer ?
