The EPA and Obama Law went into affect last Friday, If regulated as written the EPA can regulate all land and every drop of water that falls in the USA , every farm operation undertaken from plowing to chemical application will have to have an EPA permit, a violation will have a fine of $37,000 a day . The farm organizations are the only ones discussing the topic and I do not believe the public knows how this will affect landowners , businesses and homeowners in the future.
A Federal Judge in North Dakota acted late on Thursday to block the Obama administration's controversial water pollution rule, hours before it was due to take effect. Judge Ralph Erickson found that 13 States suing to block the rule meet the conditions necessary for a preliminary injunction. The decision is a major roadblock for the EPA and the Army Corps of Engineers who was on Friday to begin enforcing the rule. But the Obama administration says it will largely enforce the regulation as planned. The injunction only applies to the 13 states that requested the injunction, which does not include Tx. So EPA says the law will go into effect in Texas.
The law is a done deal and will be hard and expensive to undo , from my source of information.
EPA is not ruled by Congress , it is funded by Congress, the only hope will be Congress will not fund the law. My guess is very few landowners are aware of this new law, my reason for this discussion is to inform the public.
