Any idea what kind of snake that is?

No idea. Has markings somewhat like a rattler but no rattles. Apparently "non poisonous".

anyone ever see those squirrels that will fight back with a rattler to keep it away from their young? The poison wont kill them.

The size and way he acted, I'd say a "rat snake". He didn't act like a rattler, and his head did not appear big enough nor his body thick enough to be a moccasin although the way he went for the tree and the surrounding vegatation may suggest that he was. I however am inclined to stay with my thought that he's a rat snake.

I let rat snakes, gartners, chicken snakes and other non-poisoness snakes live. I always have a 410 at my side to kill rattlers, copperheads and moccasins though, if they bother me. Copperheads are the #1 problem here, with mocassins #2 because of my swamp and the four water tanks, one which is close to the main house. I tend to let the rattlers live cause they seem to be less aggressive than the other two and generally when they rattle I can do a nice slow move away. I will kill them however if posing a danger, plus they're goooood eating. One exception with a rattler though, they tend to get pretty angry when wrapped up in a round bale. :shock:

Would have been a dead snake if my old man would have seen it.
