Neighbor has about 800 acres he is interested in renting. He says he is taken written proposals. The place is covered with cherokee roses and hasnt been fertilized in 15 years. The fences are in very poor condition and the catch pen is rotten. He wants the propasals to describe in detail what will be done with : fences, spraying ,frequncy of bushogging, lease length, catch pen, fertilization program. The winning proposal will be used as part of the lease and this guy seems to be very unflexable about changing anything after the lease is signed. He is getting about 22 per acre now.
How would you handle this deal?
 
First question is can you can get along with him?
Second question is what is important to him?
Third question is wether he will accept a 7 to 10 year lease to recapture some of the improvements that need to be made?
 
Can you get along with him is the big ?

Sometimes it's just not worth it.Its one thing if they have high standards if the place is in top condition to start with,but high standards on a place that needs lots of work? Sounds to me like he is trying to get you to pay him for cleaning it up.He's got everything to gain.

I agree. Either do this, or pass on the project. He's looking for someone to clean the place up and build him some free facilities. I don't think so....

I would have to agree and recommend to pass on this one.

However, if you are like me and look for any oppurtunity to expand, keep in mind he is wanting you to improve his land so he can probably sell it at some point.

I would recommend this. A 10 year lease, so you get to benefit from the work that will be done, keeping in mind the first 2-3 years will be spent improving the place. He pays for ALL of the fencing expenses, no questions asked. If there is alot of spraying that needs done, you will want to think about wether he should share that cost with you as well.
I would definitely work a first right of refusal into the deal. In other words, at the end of the lease period, if he has another offer to rent the ground at a higher rate, you can simply match that offer and continue renting the ground for an additional 3,5,7, etc years. Or if he wants to sell it, you can simply match the agreed upon sales price he gets, and you can buy.

In the end, I think I have this type of person pegged. He hasn't done a darn thing to his ground in many, many years. Now he wants to rent it, and the first time you would do something he doesn't like, he will probably chew your arse big time. Even if it was something he had been doing or not been doing for years. He also wants you to improve his ground. He would also be the type to try and terminate the lease if you do one thing outside of the lease agreement.

Maybe just ignore that one paragraph and just walk away..... I have been looking to expand for a couple years, and I will probably get that oppurtunity next year. It is hard to pass on deals that might work, but sooner or later a good one will come along. Patience is hard, especially if you are young like me.
 
A friend has been renting pastures from one of her neighbors for a few years now. Hill ground; poor fence, weedy in sections, low pH, etc. Nothing has been done by the owner to maintain the fences or improve the soil in a very long time. You have all seen places like that. My friend does fertilize it at her own expense. A couple of years ago, the old gal that owns it sat down to discuss terms for the lease renewal, it is year to year. The old raisin said she thought Suzy should bring the pastures "up to snuff." Suzy replied, "Really, and when was the last time they were up to snuff? I'll tell you what. You bring them up to snuff and I will keep them that way." Needless to say, that was the end of the old woman's demands.
 
heres the thing if you lease that place.its going to cost you $17600 a year.an you say the place in bad need of fencing an shredding.fencing 800acs is gonna cost some big bucks.an i bet the land owner wont want to pay for building new fences or a new corral.now all i can tell you is this can you afford to put in new fences an a corral an pay $17,600 a year lease.now for the bare bones.if i took on that deal i want a 15 year lease in writing.an lastly how meny cows can you run on the 800acs.

In reading your original post, I struck me that you already have given this deal a lot of thought, and have already decided that it would not be worth it!

I know yawl are right. something better has got to come along.
On a side note the owner told me he had put a lien on the current renters cattle. Says the renter is late on the rent payment. I didnt even know someone could put a lien on someone else's cattle.

I'd handle it by passing on the deal.
 
Its not a sweet deal, just because of the owner. If he's a crook, I'd pass. But if he's just hard to get along with, I'd have to consider it. It sounds like something that not everyone is going to jump on, but for me that spells opportunity. I've never been handed anything nice, always had to put up with something to get something.

I guess if it were me, I'd have to weigh it against my chances of something else better coming along, soon. With that in mind, I would probably shoot him some kind of proposal. He might not like it but then again if he's "that kind of guy", he might only get one proposal...mine. I'd see if he would be willing to pay for corral and fencing materials and lime to certain PH. You didn't mention water? I might provide labor to build fences. I might also propose electric fences, that are easily taken down and away if things go bad and a portable corral for the same reason. I'd probably pay for seed, pasture rennovating, with a long enough lease that I would get the full benefit of it.

I would not do things that will drastically improve his chances of getting more for the land, because that might burn you down the road.

I'd include every detail I could think of, and have a lawyer write it up so my bases would be covered.
 
He sounds like a greedy anal idiot that I could not get along with. Fix his fences and the pen and he'll jump the rent on you.
