I rent land from my dad. I have a lease, pay monthly. I have 31 pet cows. I pay $681/month. Going to winter goes to $910/month cause of water tanks. I have had 1 month grass due to drought, weeds. I pay for all care, food, fences, do all care. I'm not allowed to use tractors, side by side, his hay feeders. I was using 30 year old feed bunks already there. He took away this week. Said to buy my own he's taking them to scrap metal. He's had a scrap metal pile for 20 years not taken.

He expects me to repair all 30 year old wood posts rotted. Fix fences his bulls damaged. He charges me for weed killer but per my lease he was supposed to provide all. Then he takes all my old dirt, manure, hay for free. It's in a huge pile. 4 huge 30 ft piles. In my pens & leaves gates open so cows go out I get in trouble. I carry my own insurance on them.

He shut off water to extra tank the other day. I called out on unfair treatment as a landlord. He owns my apt I rent. I haven't had a working stove for 1 year. He's paying thousands for elective bug treatment for tenants bringing in bugs. He's bought them a kid pool, diapers, wipes, plumber multiple times. Caters to them. While not paying proper maintenance. Both water heaters need fixed before winter. He pays for them to play in a sprinkler but I can't run a fan for cows. Exterminator told him to kick them out 2x. He said can't they just paid. For me saying not fair threatening to kick me out. Ban me-i pay double they do. In turn now he's locked me off of property holding my cows hostage. I can't check or care. I called cops they just said would come when I move. But I can't even plan to take them. No hay no water. I'm going to lawyer. I called extension office as well. I should be paying change a day. Less than feed lot prices/yardage
 
Hope you have all receipts, copies of any, all signed agreements.. Don't know all the fine print... but he can be counter charged for stealing cattle..
Please tell us that you have receipts or proof of ownership of cattle too.
Sounds to me like he might have some mental issues??? How old is he? Dementia, alzheimers, other mental problems.
You need to get out of there... totally.... for your own sake. And sad as it is, you may just need to sell them....
 
Yes he's 80 I think dementia. A lot why I stayed an excuse to check on him. I have an aunt, sister, cousin in his head that he's paying for everything. Same sister who got him to cosign a house, pay her bills while I was calling his Dr cause he had aggressive bulls running loose not taking responsibility, 1 snapped took 6 fences after Me last year. He blamed me. Everyone told him the bull was a killer. He had 7 adult bulls he sold finally a couple months ago. I have everything as far as lease, receipts. Pictures of gates locked, new no trespassing signs. I don't have papers I own them cause they were free didn't pay. But insurance, I'm on social media-pictures, vet can say, tons of farmers, hay people.

You need to get out of there... totally.... for your own sake. And sad as it is, you may just need to sell them....
He also paid for extra trash for tenants vs saying they needed to take stuff to dumpster. But says I can't use dumpster for feed bags. Have to take with me. I have a couple backup places to go. Just don't have the shelter I do there. But I'd save a lot of money. He tells me to buy a tractor but can't keep there. I live 30 miles away. It's been a year of if he gets mad says my sister gets everything. He was doing this before. So why I got a lease. But he's not paying for his part. Plus rent is way overpriced. My cows are all I have. Obviously I have nothing to do with my family. I also have a 1 of a kind steer. An Angus last weight he was 3,381 lbs.
 
sounds like a really bad situation. I know first hand that family problems can be really stressful. my advise would be to find someplace you could call your own and gather your belongings and let things settle down. If you need to cut the lock to get your cows, so be it. good luck
 
Who is his POA ???? Someone needs to have him evaluated.. sounds like he is in need of someone else to take care of his life now... and if he is going to be aggressive, possibly committed to some sort of facility... at the least, doctor involved to curb aggression and to make diagnosis and then legalities...
I think that a lawyer and possible doctor intervention... ASAP....

It's hard to see parents... but sounds like you have some backup with previous incidents like with the bulls...
 
If you have a backup place to go... then do it. Deal with the aftermath... cut the locks, move the cattle... and if the sister gets the place then so be it... You can only do so much...

Stop letting him control your life. Get the cows moved, and then get your life in order... whether you inherit or not, you need to get your situation straight at this point.

I'm worried my sister is. Last year when the one bull snapped, he wasn't taking responsibility & checked out. She was getting him to cosign a half million dollar house. While he was charging me saying cosigned a car for me. I called him into his Dr. Got taken off his medical stuff. I've called his Dr multiple times. When I say something about unfair treatment like paying her bills then charging me. He kicks me out. Why I got the lease. The one tenants here brought in bed bugs repeatedly. It's elective treatment. He keeps paying. Won't kick them out. They pay him late yet bought a new car pay everything else first. He treats them great. Me I have to pay. I think I was supposed to inherit the farm. So was waiting. But I can't deal with the stress. I took care of him, my mom when she was sick & dieing. Him after. My sis takes credit. She's been there 4 times since my mom passed 3 years ago. Last time was when he got check from bulls. I was hoping to wait to go to court get everything investigated but way past time
 
It's a no-win. Get out now and save yourself the headache. Put your energy in to some thing more positive. There is now cow worth that mess.

Let him go to the market with that BS amd see how it goes.
If can get gates unlocked I'm going to line up trailers and go elsewhere. But can't just have people on standby. This will be a huge fight. I also have a 1 year lease he can sue me on if don't do things legal.
 
Get the lawyer.. locking you out should negate the lease terms...as long as you are paid up to date... he cannot do that without suffering consequences... and animal control/cruelty can get involved....

If sister is POA, and he is not being taken care of, she can get removed legally... have a friend who's sister was POA and she lived closer than friend, yet friend was up there (5 hour drive) constantly and finally had to get lawyer involved in lack of POA doing job.

It gets messy... he cannot hold you to lease if he does not allow access... You have some legal ground to stand on.... EXERCISE YOUR RIGHTS.... cattle not being taken care of can get a whole 'nother bunch of legal stuff going on.... AGAINST HIM....
GET THE LAWYER.... make sure that vet and everyone knows that you have been locked out... you said police have been talked to... DOCUMENT it all as you go...

See about getting things lined up to move cattle... get cops involved with a lawyer's document or something, that gives you the right to remove your animals...and prevents him from stopping you from moving your cattle... and then DO IT.... let him threaten all he wants... Find another place to live and have some sanity in your life again...
As long as you are paid up, all things are legal and above board and you can prove what you have done, and all that... he will not have much to stand on.
Sorry to have to tell you to get tough and "unfeeling".... but you need to; or else just give up and do as he says whether it is even fair or makes sense.... You are not dealing with someone who is mentally stable and therefore stop trying to reason with an unreasonable person.

You need an attorney not a forum. Ask 2 thinh for sure.

Can he lock you out?
(doubt he can, and the lock could always be missing the day you show up)

If you are responsible for the remaining term?
(doubt you are and even if you were I would make him sue you for it)
