SYNOPSIS: This bill would require each person who
9 possesses an automatic or semi-automatic weapon to
10 register the weapon with the Department of Public
11 Safety pursuant to procedures established by the
12 department. This bill would define automatic or
13 semi-automatic weapon. This bill would restrict the
14 use of the information received from the
15 registrants. This bill would provide for penalties.
16 This bill would provide for the disposition of the
17 fees and penalties.
18 Amendment 621 of the Constitution of Alabama
19 of 1901, now appearing as Section 111.05 of the
20 Official Recompilation of the Constitution of
21 Alabama of 1901, as amended, prohibits a general
22 law whose purpose or effect would be to require a
23 new or increased expenditure of local funds from
24 becoming effective with regard to a local
25 governmental entity without enactment by a 2/3 vote
26 unless: it comes within one of a number of
27 specified exceptions; it is approved by the
1 affected entity; or the Legislature appropriates
2 funds, or provides a local source of revenue, to
3 the entity for the purpose.
4 The purpose or effect of this bill would be
5 to require a new or increased expenditure of local
6 funds within the meaning of the amendment. However,
7 the bill does not require approval of a local
8 governmental entity or enactment by a 2/3 vote to
9 become effective because it comes within one of the
10 specified exceptions contained in the amendment.

22 for the disposition of the fees and penalties; and in
23 connection therewith would have as its purpose or effect the
24 requirement of a new or increased expenditure of local funds
25 within the meaning of Amendment 621 of the Constitution of
26 Alabama of 1901, now appearing as Section 111.05 of the
1 Official Recompilation of the Constitution of Alabama of 1901,
2 as amended.
3 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
4 Section 1. This Act shall be known and cited as the
5 "George Amison Jr. Act".
6 Section 2. (a)(1) Any person who possesses an
7 automatic or semi-automatic weapon shall register the weapon
8 with the Department of Public Safety pursuant to the
9 procedures established by the department. The registration
10 shall contain a description of the weapon that identifies it
11 uniquely, including all identification marks, the full name,
12 address, date of birth, and thumbprint of the owner, and any
13 other information that the department may deem appropriate.
14 The department may charge a fee for registration of up to
15 fifty dollars ($50).
16 (2) The department shall maintain the information
17 received from each registrant in an automatic or
18 semi-automatic weapon registry and information contained in
19 the registry shall be released only to law enforcement
20 officers.
21 (b)(1) Failure to register an automatic or
22 semi-automatic weapon is a Class A misdemeanor.
23 (2) Notwithstanding subdivision (1), failure to
24 register an automatic or semi-automatic weapon is a Class C
25 felony if the weapon has been used by the person in the
26 commission of a crime.
1 (c) The proceeds from the fees or fines received or
2 collected by the department or any court under this act, less
3 administration and processing costs, shall be deposited into
4 the Alabama Crime Victims Compensation Fund.
5 Section 3. For purposes of this act the term
6 "automatic or semi-automatic weapon" shall mean a weapon that
7 shoots, is designed to shoot, or can be readily restored to
8 shoot, a succession of bullets so long as the trigger is
9 depressed or until the ammunition supply is exhausted or a
10 weapon that fires a single bullet each time the trigger is
11 pulled, without the need to manually operate a bolt, lever, or
12 other firing or loading mechanism. The term does not include
13 any firearm modified to render the weapon permanently
14 inoperable.
15 Section 4. Although this bill would have as its
16 purpose or effect the requirement of a new or increased
17 expenditure of local funds, the bill is excluded from further
18 requirements and application under Amendment 621, now
19 appearing as Section 111.05 of the Official Recompilation of
20 the Constitution of Alabama of 1901, as amended, because the
21 bill defines a new crime or amends the definition of an
22 existing crime.
23 Section 5. The provisions of this act are severable.
24 If any part of this act is declared invalid or
25 unconstitutional, that declaration shall not affect the part
26 which remains.
1 Section 6. This act shall become effective on the
2 first day of the third month following its passage and
3 approval by the Governor, or its otherwise becoming law.
