That's NOT TRUE, High Grit -- that a felon caught with a gun equals death penalty. Normally, someone on probation or parole is caught with a gun, and they get sent back to prison for the term they would orignally have gotten (probation) or more (parole), if it is treated as only a violation of their conditions. New charges could be filed. If a firearm is used in part with a robbery, drug deal, assault, attempted murder -- for some cases, a gun in possession will only be an "enhancement" of 5 yrs. or so to the normal penalty. Few charges, in few states, are now death penalty cases.
